Anyone caught with pot in their Car gets a DUI. It's a money making scheme sine u get jail time plus a years probation which is costly plus 40-80 hours of community service which is costly, months of drug classes which are costly, drug testing- costly. Then eventually many violate probation either by smoking or drinking or even getting pulled over and then you do your full jail term, lose your job etc

It's a big crock to keep the jails filled and bring in cash.
