If you swipe a candy bar in the store, you are committing a crime even if nobody cares. Same as if you let an insurrectionist hold office without voting by 2/3rds vote to remove the disability.

According to the Constitution, Congress has the sole authority to decide if they need to address it or not

If they do not remove the disability by a 2/3rds vote, it will be an illegal certification.
