Trump claims new Jack Smith filing is election interference. Here's how it became public.

(NBC News) WASHINGTON — Former President Donald Trump and his campaign have accused special counsel Jack Smith of violating long-standing Justice Department norms by including new revelations about his efforts to overturn his 2020 election loss in a filing released Wednesday.

In reality, a federal judge, not Smith, made the decision to release the filing to the public.

Trump on Thursday called it a "weaponization of government" to release the filing just a month before Election Day, alleging that Smith and federal law enforcement officials were improperly influencing a presidential election.

It's true that the Justice Department typically abides by an informal 60-day “quiet period” before an election — meaning it avoids taking discretionary action that could be seen as influencing voters. The new disclosures from the special counsel's office, however, were made in an ongoing criminal case at the order of a federal judge, Tanya Chutkan, who ultimately made the decision to release the redacted filing Wednesday.

5. The judge isn't part of the DoJ; she's in the judicial branch. DoJ is executive branch.

The judicial branch isn't bound by policies of the executive branch; separation of powers and all that. Anyhow, there is no "60-day rule." DoJ has had an unwritten policy for years against federal prosecutors indicting a candidate, or federal law enforcement taking “overt” investigative steps regarding the candidate soon before an election, but there's no 60 day or other time period. DoJ has no policy at all forbidding an already-indicted candidate from being put on trial close to an election day. It does have a written policy in its Justice Manual, at 9-85.500 Actions that May Have an Impact on an Election, that says:

Federal prosecutors and agents may never select the timing of any action, including investigative steps, criminal charges, or statements, for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party. Such a purpose is inconsistent with the Department’s mission and with the Principles of Federal Prosecution. See § 9-27.260. Any action likely to raise an issue or the perception of an issue under this provision requires consultation with the Public Integrity Section, and such action shall not be taken if the Public Integrity Section advises that further consultation is required with the Deputy Attorney General or Attorney General.

But this has nothing to do with how a judge, not under DoJ, schedules an existing case.

It is indeed disturbing that one of the most odious characters to walk the earth since 1945 has any supporters at all. But Hitler had a lot of supporters, too (and still does, unfortunately), which I suppose proves that some people just suck.

I can remember several times, including the times he hoarded the PPP supplies that were supposed to go to US hospitals during the first few months of Covid. While Americans were dying in hospitals at the rate of hundreds per day, the PPP supplies that were backordered by hospitals in New York, Philadelphia, and elsewhere were SOLD to China by Chump and Jared Kushner. They also slow-walked the US research for Covid vaccines because they didn't want people to panic, and also because the people who were dying were mostly in the "blue" states. There was so much shit that Chump did as President, and hasn't been investigated, he's never been charged.

The truth about Jack Smith is that Chump has caused the delays in this trial. If it had been up to Smith, this trial would have been over 2 years ago. Well ... at least 1 and a half years ago. Chump is the reason why it's still being litigated this close to the election

Be that as it may, Trump cannot escape accountability to the people for his actions on January 6th. Not only is he going to pay dearly, we are seeing the last gasps of a dying political party right in front of our eyes.
