WASHINGTON (AP) -- The government of El Salvador has acknowledged to United Nations investigators that the Trump administration maintains control of the Venezuelan men who were deported from the U.S. to a notorious Salvadoran prison, contradicting public statements by officials in both countries.
The revelation was contained in court filings Monday by lawyers for more than 100 migrants who are seeking to challenge their deportations to El Salvador's mega-prison known as the Terrorism Confinement Center, or CECOT. ... The case is among several challenging President Donald Trump's immigration crackdown.
"In this context, the jurisdiction and legal responsibility for these persons lie exclusively with the competent foreign authorities," Salvadoran officials wrote in response to queries from the unit of the U.N. Office of the High Commissioner for Human Rights. The U.N. group has been looking into the fate of the men who were sent to El Salvador from the United States in mid-March, even after a U.S. judge had ordered the planes that were carrying them to be turned around.
The Trump administration has argued that it is powerless to return the men, noting that they are beyond the reach of U.S. courts and no longer have access to due process rights or other U.S. constitutional guarantees. ... But lawyers for the migrants said the U.N. report shows otherwise. ... El Salvador has confirmed what we and everyone else understood: it is the United States that controls what happens to the Venezuelans languishing at CECOT. Remarkably the U.S. government didnt provide this information to us or the court, American Civil Liberties Union lawyer Lee Gelerent said in an email.

BREAKING: Documents filed in court today assert that officials from El Salvador told the United Nations that it "facilitated the use of the Salvadoran prison infrastructure" by the U.S. but that "the jurisdiction and legal responsibility for these persons lie exclusively with the" U.S.
As set forth in the attached Report, the Government of El Salvador responded to the UN
inquiry opened by the four families asking about the disappearance of their family members:
1 The attached exhibit has redacted personal identifying information for the four men discussed in the WGEID report. Petitioners can file an unredacted version of the exhibit under seal at the Court's request, with the exception of one of the cases for particular privacy reasons related to that individual.

The Salvadoran State emphatically states that its authorities have not arrested, detained, or transferred the persons referred to in the communications of the Working Group. The actions of the State of El Salvador have been limited to the implementation of a bilateral cooperation mechanism with another State, through which it has facilitated the use of the Salvadoran prison infrastructure for the custody of persons detained within the scope of the justice system and law enforcement of that other State. In this context, the jurisdiction and legal responsibility for these persons lie exclusively with the competent foreign authorities, by virtue of international agreements signed and in accordance with the principles of sovereignty and international cooperation in criminal matters. In this regard, the actions attributable to the Salvadoran State are limited to its sovereignty and territorial jurisdiction, and therefore it cannot be held responsible for the failure to observe the principle of non-refoulement with respect to the persons mentioned.

(65,868 posts)If there's nothing going on at the Prettyman Courthouse in DC, where Judge Boasberg is located, you can get on the Green Line at Archives and go up to Greenbelt, where Judge Xinis is located.
I am not a lawyer. I'll do what I can to keep the updates coming. You and In It to Win It are doing a terrific job.
And good evening.

(166,916 posts)The trump DOJ has lied to a good number of judges
President Donald Trump's administration controls the fate of migrants it has deported to other countries like El Salvador, officials claimed in a court filing on Monday.

The claims contradict the Trump administration's position that it has no authority to return the migrants once they've been sent elsewhere. That was the argument they used to try and circumvent a court order to facilitate the return of Kilmar Abrego Garcia from El Salvador's infamous CECOT prison to the United States.
Salvadoran officials pushed back on those claims in a new court filing, saying that "the jurisdiction and legal responsibility for these persons lie exclusively with the competent foreign authorities, by virtue of international agreements signed and in accordance with the principles of sovereignty and international cooperation in criminal matters."
Said another way: The Trump administration "is in charge" of the migrants even after they cross U.S. borders, Lee Gelernt, a lawyer with the American Civil Liberties Union, told The Washington Post.
Trump has deported immigrants under the Alien Enemies Act, a centuries-old law that allows the president to immediately deport people during wartime. In past media appearances, Trump has described illegal immigration in the United States as an invasion, although he has not officially filed a declaration of war against any country.
The Supreme Court has also said that the Trump administration needs to allow immigrants who are being deported sufficient time to challenge the claims made against them.

JUST IN: Judge Gallagher says either El Salvador is lying to the UN or the administration is lying to her about the people deported to CECOT.
