Lawyers for Hannah Dugan, the Wisconsin judge indicted on federal charges for allegedly impeding government agents during an immigration bust, say she "wants a trial date" as soon as possible revealing Wednesday that her obstruction case is reportedly "hanging over her head" as she's continues to be "out of a job right now."
Dugan's cries apparently fell on deaf ears as U.S. District Judge Lynn Adelman chose to delay the Milwaukee County judge's July 21 jury trial date indefinitely at a hearing Wednesday, while Dugan's lawyers had argued for keeping things on schedule. Adelman wants to first weigh a motion to dismiss filed by Dugan's legal team last month before setting an official trial date, according to court records.
Adelman said he sees where the judge is coming from, but he also wants to make sure the case is "done right," according to the Milwaukee Journal Sentinel. "I understand that she wants to be working, but this is a sort of complicated case," Adelman told Dugan's legal team. "We want to do it right," he reportedly said.
Dugan's lawyer Steven Biskupic, who is a former U.S. Attorney, fought for the original schedule to be upheld Wednesday. "I've got a client who's out of a job right now, who's got this hanging over her head," Biskupic said, per the Sentinel. "She wants a trial date."

Hold them from their elected offices any way he can. That judge probably got some high level communications from someone (Nosferatu, maybe?) and is going to drag it out so that the judge cannot do her job and possibly rule things against the ruling family or their cronies.
At least, that is my opinion on the matter.

They know they don't have a case and are going to be humiliated. Regime falls? Every single individual I evolved in this from those who arrested her to the judge doing their bidding needs to face a reconciliation tribunal.

(45,465 posts)The 70-day speedy trial clock typically starts after the arraignment and the arraignment in this case took place on May 15. But under the Act the 70 day period is tolled by the filing of a motion to dismiss. Dugan filed a motion to dismiss the indictment on May 14, but didn't file a memorandum in support of that motion until May 29.
The July 21 date, arguably, was well within the speedy trial act requirements -- which is probably why Dugan's counsel didn't object to the original schedule, under which the government's reply to the motion to dismiss was due June 9 and Dugan was given until June 16 to reply. Nor did Dugan's counsel push for prompt action on the motion to dismiss, which was pending before a magistrate judge, not the judge assigned the case for trial.
And I'm unaware of there being such a thing as a "reconciliation tribunal' in the US.

(7,978 posts)If he dismisses the case, all rump can do is appeal, which he'll do one way or another. Her motion is an immunity defense?
This case is important to us all, as handcuffing a judge and doing a perp walk from her courtroom is an invasion of the judicial system which rump is trying to control. We can't let him do that.
It is unique in that the Judge that will grant or deny her motion is himself a judge with some idea of his own immunity, too. There's nowhere Dugan can go where she would not be judged by another of her peers. I guess the RW SC can look forward to twisting the law again.
I dunno. Put me on the jury. I think that she was in command of her courtroom, in command of the immigrant guy, and had a right to tell him which door to go out. She had a right to do that, especially if the paperwork was not in order. It's not her fault that ICE was incompetent, but it's her job to know--at the very least, she had a right to maintain order in her own courtroom.
Kudos to this Judge who had the guts to tell ICE they didn't have it together.

So apparently when you file motions in this judge's court they just lay around until a scheduled hearing date on progress and then he might decide to take up reviewing the motion? As I recall this judge has dragged out other cases as well.

June 9 - Government responds to motion to dismiss
June 11 - Dugan's counsel files for leave to file oversized memorandum
June 13 -- Judge Adelman, assigned to be the trial judge, issues an order scheduling a status conference, noting that the motion to dismiss is still pending before the magistrate judge.
June 16 -- Dugan's counsel file reply to government response
June 18 - Judge assigned to try case holds status conference at which he vacates the trial date, pending decision on motion to dismiss.
Note that Dugan's counsel did not object to the original schedule, undoubtedly because it was well within the Speedy Trial Act timeline, under which the trial date would have been in August, if not later.
