Go ahead, retire…let Trump appoint Barron to the Bench…it won’t matter because in 2029, if Democrats want to get anything done in regards to restoring democracy and repairing the damage of the Trump era, they are going to have to kill the filibuster and expand the court.

It doesn’t matter how many justices retire this year, as long as Dems assert their commitment to court expansion.

If a Dem AG (no more Special Prosecutors since Trump will never be a presidential candidate again) decides to seek charges for crimes that haven’t passed the statute of limitations, then a judge would be selected from a pool (only 3 in the MAL district IIRC).

The next Dem AG will already have an evidence base (Thanks Merrick Garland!- seriously, it’s the one thing Cannon couldn’t exclude because it was obtained before Smith was appointed) to justify a search warrant for classified documents. Hopefully, they will conducts raids/searches simultaneously in NY, NJ and MAL.

We will have two options if it happens. The first is to hope that it doesn't happen until after the midterms when we have the votes to turn down extremist, lying judges.

The second is to expand the number of judges when we finally get back in power. And seriously, I hope it doesn't come to that, though it does make sense mathematically.
