(49,812 posts)This is not a choice DOJ directs, though I suppose the power of the purse and Congressional funding is a factor in the long term. But if DOJ attempts to neuter the work of US Marshalls we'll have another imminent crisis for judges to rule on.

Simply put "Will" is always for the future, "Shall" is imperative now.
Should does not belong in policy, it is always aspirational.
May is used both permissively and conditionally (You may open the gift - permission; you may fall over - condition).
Of course conventions don't seem to mean much to the current regime, so YMMV.

I think the courts can declare Trump and his administration in insurrection or rebellion against the constitution of the United States and automatically removed from office. Anyone who comes to their aid will be similarly guilty of insurrection.
The courts have the power to remove Mango Mousolini from office if he defies a supreme court order.

(94 posts)A president must be removed through a trial and a conviction in the Senate after the House impeaches. The Senate trial is to be presided by the Chief Justice. But the Supreme Court cannot unilaterally depose a president WITHOUT DUE PROCESS. There are no exceptions.
Please respond if you have documentation that states something different.

Their comments tended towards... while there's no precedent for such, SCOTUS has already carved out a great deal of power for their selves and how they may choose to apply that.
The overall assessment was that time will tell.
I have updated my comment to reflect that very thing.

(55,844 posts)A majority in the house and 2/3 of the Senate for impeachment and conviction. A cabinet vote for the 25th amendment. No amount of figuring out changes that. Trump has been impeached twice. Without conviction its meaningless. There may be a solution, but those two options are not it.

(113,501 posts)So they put them on a bus and moved them to a different location where the injunction did not apply. They are scheduled to fly out tonight. They are frantically working to stop the deportations tonight.

(94 posts)their law licenses get revoked. A judge would have an audience with a new set of ears if that consequence were on the table. But I guess that it's far too complicated for judges to use that ultimatum to exude honesty from lawyers, so it won't happen.

(51 posts)that may indicate US Citizens being sent abroad to serve prison sentences may (and should) spark a MAJOR MAJOR MAJOR pushback, possibly physical, from Americans nationwide. This is how a country fights itself to death.

(94 posts)We know what Trump's capabilities are. Trump, however, doesn't know what the citizens' capabilities are. For certain, Trump will kill people to maintain control. For him, killing is just a means to an end. Look at what he did with the COVID crisis. He killed hundreds of thousands to maintain control, and he'll do it again. We don't want to think of what a monster he is. All of those COVID deaths were NO ACCIDENT.
