This is more of a legal question.
Is Trump not officially a convicted felon until the judge sentences him?
Is that why he keeps delaying sentencing for a guilty verdict that happened 6 months ago?

(122,112 posts)A conviction occurs upon either pleading guilty or receiving a guilty verdict, which has happened. The judgment of conviction occurs when sentence is imposed; it is the entry of a judgment of conviction that begins the defendants time to appeal. NY Criminal Procedure Law 1.20(13)-(15). Trump will certainly appeal the conviction, which he has the right to do, but he was convicted when the jury returned the verdict. The reason he's got his undies in such a bunch is that now he has to appear, either virtually or in person, before the judge who was so mean to him and face the legal music - the legal and actual reality of his conviction - even though he won't do prison time (and that was never going to happen), just before his inauguration. It's public and it's embarrassing and it reminds the public that he's a sleazebag who paid off a porn actress and hid the evidence of the payoff.

(979 posts)Guess Trump's hoping to delay sentencing until January 2029. And in the meantime hoping to get SCOTUS to throw out the case entirely so he can claim he was exonerated.
Amazing he cares so much about avoiding the "convicted felon" label. 77 million Americans didn't give a shit.

(979 posts)So even though the jury found him guilty on all counts back in May he's not officially a convicted felon until the judge signs off on the verdict and imposes his sentence?
Which is odd because even a lot of his supporters accept that he's a convicted felon and couldn't care less.
In fact some decided to vote for him after the guilty verdict because they believed he was being targeted by our weaponized "liberal justice system."
Sounds like even Trump knows being a convicted felon who's case is on appeal while serving as President is embarrassing.

(1,422 posts)But yeah, Trump doesn't want the stain of being a convicted felon on his record. He's very embarrassed and angry over it.

(979 posts)The judge has already delayed it 7 months and rejected all the defense motions.
Only Trump could get away with avoiding even being sentenced on a unanimous jury verdict.

(3,690 posts)that he still maintains that he made part of the porn star payment while he was president -- so it was an official presidential act. Laugh each time I hear it.
"Oh, of course! Every POTUS pays off his Official Presidential Porn Star when he reaches the oval office -- it's an official duty."

(979 posts)The Shady Six might give him presidential immunity and throw out the case entirely.

(122,112 posts)that's what he is, now and forever. He can't appeal until after sentencing, but he's convicted as of now.

(979 posts)I assume after January 20th other countries won't restrict him from entering because he's a felon but it would be nice if they had that option.
Silent Type
(7,740 posts)sanctions, etc. He's still a convicted felon for all practical purposes, but it didn't matter to enough voters unfortunately.
Just because some podcaster claims trump is screaming about his sentencing according to "sources," odds are he is not.

(17,322 posts)That way he can say he was exonerated of all charges and the attempts to convict him were all elaborate exercises in the weaponization of justice.
They were jealous of his never been seen before popularity. Also the perfect way the government functioned during his first term in office, they resent his multitude of pResidential successes.

(8,702 posts)US Congress showed him that, the judicial system showed him that, the American voter showed him that.
Why would he be afraid? Only the common people are afraid of the American justice system. That is the way it was designed.

(979 posts)An unconditional discharge - no jail time, probation or even a fine.
But the guilty verdict would be signed off on and case closed. So Trump would have to then appeal the verdict to higher courts which could take years to decide. No New York state court is going to overturn it so it would be up to SCOTUS.
I think Trump's only real concern is about the optics of taking the oath of office on the 20th as a convicted felon.
His ego can't handle it.

(979 posts)So until he's sentenced he can still do all those things. But once he officially is on the books as a convicted felon the restrictions start. That makes sense.

(13,738 posts)His public image is everything to him.
He can handle his "peers" - fellow grifters and criminals dissing or ignoring him as long as he gets his money, but the sheep and marks? The lesser folks? His "enemies" he can crush?
That's too much for him to bear.
He's got to be the Protagonist of the World in public. His Ego demands respect, if not outright worship from his prey.
